Vatikim Company has the right and possibility to adapt or modify at any time the terms and conditions of the present contract regarding General Conditions of sale. In which case they will be applied to every order from the very day of publication of the amendments/ changes to the terms and conditions on the site.
Vatikim SA may at any time modify its prices but undertakes to apply prices or rates which have been indicated to you during checkout of the order.
The photos of products sold on Vatikim SA website are not contractual especially the rendering of colors that can vary according to your screen / device and your device settings and/or screen.
However, they illustrate accurately products sold on the site.
2. Availability of products
Our offers of products and prices are valid as long as they are displayed on the site, within the limit of stocks available.
At receipt of your order, we check the availability of the ordered product. In case of unavailability, we will replace it within 7 days after confirmation of the order, either to deliver the ordered product or offer a similar product at similar price, or to proceed with the refund of your order if any similar product suits you. We shall ask you to inform us your written request either by mail, be it refund to you in the form or having and gift certificate for a third person, at your convenience. 3. Validation of orders and electronic signature (law of 13 March 2000 on electronic signature)
Any purchase or electronically accepted on the order form by the client/customer constitutes irrevocable acceptance which cannot be cancelled or subject to any question only within the limits provided for in these General Conditions of sale. The validation of the purchase order, associate to authentication and non-repudiation and message integrity protection constitutes an electronic signature. This electronic signature has legal value between the parties in the same manner as a handwritten signature
All products purchased on the site Web of Vatikim SA are warranted against defects in workmanship under normal conditions of use. The duration of the warranty appears on the data sheet of each product / section in short description as well as the estimated delivery date. The document attesting warranty which shows the date of purchase is the invoice that you receive in the mail. If during this warranty period, it turns out that the product is defective, it will be replaced at the discretion of the manufacturer. The purchase invoice will be required in order to apply this warranty, determining the date of purchase of the product.
5. Terms of payment and data security
5.1 Payment method
You can make the payment is:
By credit card: payment on Bank servers secure from our partners (PayPal or PayMill). This means that no information other than the details of your order passes through Vatikim site and any data regarding your banking information.
By bank transfer or postal check: your order will be processed upon receipt of your check and after validation of bank credits. Beyond 7 days, without reception of your check, the order will be cancelled.
Your credit card details are encrypted by SSL (Secure Socket Layer) and no information never pass not encrypted over the network. The payment is made directly with the Bank or PayPal or PayMill.
Vatikim SA has no access to these details and therefore keeps none of them on its servers. That is why they must to be informed for each new transaction / order on our site.
5.3 Clause of reserve of property
The products remain the property of Vatikim until full receipt of your payment. However, upon receipt of the order by the customer, relatively to transport and delivery risk is transferred to the customer at the time of the expedition, whatever the mode of delivery chosen and regardless of financial conditions of delivery (the delivery can be, free or charged to the client).
5.4 Acceptance or refusal of the command
Vatikim has the right to accept or to refuse an order / delivery or to honor or not an order from a consumer who has not paid totally or partially a previous order or with whom a dispute is underway.
5.5 Use of gift vouchers
Gift vouchers or promotional coupons can only be used only for the purchase of products on the site. These coupons promotional and/or vouchers are personal and can be credited to your customer account, but not to be an application for refund or converted to a refund check.
6. Terms of delivery and delivery time
In general, the products are delivered to the delivery address you indicated during the ordering process. The delivery depends on the geopolitical situation of the place and may therefore be subject to restrictions that it is to your jurisdiction and competence to verify if in doubt please contact us prior to ordering to confirm with us the delivery process.
We deliver you directly and free to your home from 60 € of purchase per order. Below this volume of purchase, the delivery remains free of any information. The conditions necessary for free delivery can be canceled at any time without notice.
Under 60 € of purchase per order, the delivery is payable up to 8 € for europe in delivery Colissimo.
6.2 Delivery delays
If you place your order before 12:00 Western European time, it will be treated in the same day. After 12.00, it will be processed the next day morning. All the announced time is calculated in business days.
These delays are indicative and should be checked on the website of the chosen carrier/ transporter, Chronopost delivery should be within 24/48 hours working in national territory others destinations, such as Americas or similar depending the country for 7 days observed average delay. Please refer to transporter/carrier website.
Against signature of the consignee should be within 10 days at for international deliveries.
We deliver you to the delivery address and the package will be presented once. In case of absence, you will be notified of the passage of our delivery and package will be represented again the next business morning.
An authorized person to receive and sign the delivery receipt must be present at least the delivery of the second delivery, in case of absence you will be notified by a notice and you can then collect your parcel in the nearest post office or authorized delivery point, maximum 14 days.
Vatikim SA is not responsible for the breach of contract, due to the occurrence of an event not expected such as strike total or partial of the postal services, carriers, customs and/or qualified disasters natural caused such as floods or fires, etc...
Case of professional Customers
In the specifications of the products purchased for meet business needs (resellers, shops, wholesalers), Vatikim SA will incur no liability for any consequential damages by reason of the current, operating loss, loss of profit, damage or expense, that may occur.
8. Treatment of non-distributed packages
If any of packages were not delivered to the final recipient for the following reasons:
NPI (does not live at the address), unclaimed (they are packages that have not been claimed by the recipient at the post office / delivery within the indicated maximum company) or refused (these are the packages that you refused to receive) you can ask the cancellation of the order and its refund by check. If the received product does not fit your expectations and depending /regarding to the nature of the product, and availability in stock and according to your wishes, we will propose to send you back a similar product in standard Exchange or replacement product with equivalent characteristics ( color, size, price, etc).

A check for the amount of your product will be sent to you within 15 business days following your request. In the case of a gift, you can ask the cancellation of it and its refund by check. Your check will be sent to you within 15 days following your request.
In all cases a return cannot be carried out without having notified us by e-mail at the following address: firstname.lastname@example.org
If a return was made without our written consent or without reference to has been made by mail may be rejected by our services and not be subject to a refund request.
8.2 Returns under the "spoliation / degradation"
This ground are packages which have not been delivered to the recipient because of the plunder / damage: plot empty, torn, opened, traces of shock...
If the packaging is damaged, torn, white etc., you must refuse the parcel and take contact with our services to notify us at email@example.com at the time of the refusal.
If the product is still available, and depending on the nature of the product, available stocks and your wishes you will be returned at our expense by our services after your parcel, breach of the product is returned, we shall forward you a product similar to the product originally ordered or a replacement with equivalent characteristics, otherwise a credit for the amount of your order if the costs of delivery of the product will be credited to your customer account.

9. Returning Products
9.1 Declaration of withdrawal
Product received is not suitable you: reference, default latent error, problem of size, color, features, product completely different etc... The product must be returned in good condition, unused, in its original packaging, even if this product has been opened, with all its contents and the gifts that might have been attached. In accordance with the law 722 chapter l. 121-20 and following of the Code of consumption, you have a period of 14 days following receipt of your order to inform us that you want to the return of the product to give you a return agreement number.

After receipt of your package by our services, and depending on the nature of the product, available stock and according to your wish we offer you return you the product originally ordered or a replacement product with equivalent features, at our expense. Otherwise, your account will be credited upon receipt of your package by our services. Conditions for the application of the right of return
Returns will not be accepted for all products withdrawn from sale or bearing the words "neither retaken nor exchanged 'except in the case of hidden defects."
9.2 Returns under warranty
During the warranty period, if the product is defective, it can be replaced after evaluation. To make a request for return of the product, please report it to our customer service which provides you an agreement back on your parcel number. Upon receipt of the agreement, you have 14 days to return the product. After this period, any return will be refused.
Upon receipt, our customer service will validate the return. If your product is completed under a bad ground, he may be denied and will be sent back at your expense. The reason for the return may be incorrect, however valid . Therefore, you will be notified by mail the follow-up to your request. Please refer to section # 4 of our general guarantee Conditions.
10. Shipping costs
10.1 Reimbursement of postage
If delivery costs incurred with the delivery company are known to our services, we will proceed with the refund of your shipping costs. If these costs are not known by our services, proof of expenses you will be asked by our customer service in order to be able to repay.
Free returns are free for all products which are the subject of warranty procedures. Please contact us, stating the reason for your return to our Customer Service that will send you a support agreement linked to the parcel/order to be deposited in the post office of your choice. You will not pay transportation costs. Please refer to section #9 of the General Conditions
